OMMA (Oklahoma Medical Marijuana Association) has promulgated emergency rules to implement House Bill 2807 from the 2025 legislative session. Permanent rules will go into place in 2026.
Pre-packaging requirements were initially added to 63 O.S. § 431.1 of state statute by House Bill 3361 (2024) and amended by House Bill 2807 (2025). The emergency rules provide clarity regarding which products must be pre-packaged and provide a grace period for dispensaries to sell or waste remaining deli-style inventory. In addition, the emergency rules amend language needed for Oklahoma to secure FBI approval of the national fingerprint-based background check for medical marijuana licensees and also allow commercial transporter licensees to use warehouse locations to temporarily store medical marijuana and medical marijuana products.
OMMA is working on the internal processes necessary to implement the warehousing portion of the emergency rules. OMMA will send separate communications as soon as those processes are complete. In the meantime, contact OMMA using their contact form to discuss obtaining a warehouse permit.
A current copy of the rules is posted at omma. ok.gov/rules, and the changes have been summarized below:
• Commercial transporter warehouse requirements are added to OAC 442:10-3-1(b-c) and OAC 442:10-3-1(f).
• Inventory manifest requirements for temporary storage at a warehouse location are added to OAC 442:103-6.
• Updates to the national fingerprint-based background check requirement for employees are added to OAC 442:10-5-1.1(13)(A).
• Updates requiring all medical marijuana to be sold in pre-packaged quantities are added to OAC 442:10-7-1(a).
• Rules regarding the rejection or return of medical marijuana or medical marijuana product are amended at OAC 442:10-7-1(b).
• Labeling requirements regarding the date of packaging are added to OAC 442:107-1(e)(1)(I).
• The requirement that dispensaries shall not receive, purchase, or acquire any inventory that is not in pre-packaged form, and a grace period for dispensaries to sell or waste any inventory that is not in pre-packaged form is added to OAC 442:107-2(c).
