A local man scheduled to go before District Judge Jeffrey Payton in Sequoyah County District Court in October is facing an additional charge of child sexual abuse and first degree rape, according to court documents.

The felony charges were filed against Rusty J. Waters, 44, on August 8, and reportedly stem from incidents that occurred before and around Dec. 2, 2021.

According to one of the victims, Waters had allegedly molested the individual from the time they were in diapers until 2021. The victim said because of the alleged molestation and rape, they were in diapers until they were around 6 or 7-years-old.

Authorities learned during a forensics interview that Waters had allegedly touched other minors under the age of 16, and incidents had reportedly occurred at a local motel and Sallisaw City Creek, as well as a local mobile home park, and at a Gans residence.

There were also reported alleged incidents of Waters raping the minors against their will or consent at different times, according to the probable cause affidavit filed in the case.

Court records show Waters is currently facing six counts of child sexual abuse, three counts of first degree rape, one count of rape (first degree) by instrumentation, and one count of lewd molestation.

The District Attorney’s office said each count of child sexual abuse if punishable by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or imprisonment in a county jail not exceeding one year, or by a fine of not less than $500 nor more than $5,000, or both fine and imprisonment; while each count of first degree rape is a felony punishable by death or imprisonment in the State Penitentiary for not less than five years.
